Terms and Conditions for the Sale of Passenger Transport Services

These terms and conditions for the sale of passenger transport services (hereinafter – Sales Terms) apply to all chartered transport services provided by Hansabuss Latvia SIA. The Sales Terms are an irrevocable part of the passenger transport agreement between Hansabuss Latvia SIA and the Client. Unless otherwise stated in these Sales Terms, any term mentioned herein is used according to the meaning specified in the bus transport regulations (hereinafter – Transport Regulations) published on the Hansabuss Latvia SIA website Hansabuss.ee.

Reservation of Passenger Transport Services

1.1. To reserve passenger transport services, the Client must submit a quotation request to Hansabuss by filling out and sending the appropriate form from the Hansabuss website or by sending an e-mail or fax to Hansabuss.

1.2. Hansabuss will respond to the Client’s quotation request (including a proposal) to the e-mail address or fax number indicated in the quotation request or using other contacts agreed upon between the Parties.

1.3. If the Client wishes to reserve passenger transport services according to the terms specified in the Hansabuss response, they must submit an Order to Hansabuss, in a reproducible written format and in accordance with the requirements specified herein, on terms that correspond to the Hansabuss proposal. When submitting the Order, the Client must inform Hansabuss of the name and contact information of the lead passenger.

1.4. If Hansabuss is able to provide passenger transport services according to the terms specified in the Order, Hansabuss will send the Client an Order confirmation in a reproducible written format within one business day after receiving the Order. At least 1 day before the start of the passenger transport services, Hansabuss will inform the Client of the bus registration number, the driver’s name (drivers’ names), and phone number. If the parties explicitly agree, the Order may be confirmed verbally.

1.5. The passenger transport agreement is concluded at the moment the Client receives the Order confirmation. The Order confirmation or any other notice sent to the address, e-mail, or fax number as specified in point 1.2 will be considered received by the Client on the next business day after sending, at the latest.

1.6. The Client must inform Hansabuss of the receipt of the Order confirmation and pay the amount indicated in the prepayment invoice by its due date. Prepayments are non-refundable.

1.7. The Client is also entitled to submit an Order without the need to submit a quotation request. In this case, the passenger transport agreement is concluded according to the procedure set out herein from points 1.3 to 1.6.

Requirements for Quotation Requests and Orders: The Quotation Request and Order must be submitted in a reproducible written form (an Order may be submitted verbally only with the prior consent of Hansabuss). The following information must be indicated in the Quotation Request and Order:

2.1. Start date, time, and address of the trip (place of origin);

2.2. End date, time, and address of the trip (destination);

2.3. Trip route (separately for each day, including times and destinations);

2.4. Number of passengers;

2.5. Type of bus according to the descriptions provided on the Hansabuss website www.hansabuss.ee;

2.6. Any other additional services (accommodation, catering, tour guide, ferry tickets, road tolls, etc.);

2.7. Client information (company/individual name, registration code, residential/business address, telephone and e-mail address, and, if a legal entity, also the contact person’s name and contact information);

2.8. Possible special requirements or needs related to passenger requests that significantly affect the provision of passenger transport services (including passenger mobility difficulties);

2.9. Any other information significant to the Client.

Prices

3.1. Hansabuss service prices include: the fee for the use of the bus, the driver’s salary (including payroll taxes, such as social tax), and fuel expenses (including fuel excise duty).

3.2. Any costs not included in the service fee according to this point 3.1 shall be added to the fee, including driver accommodation expenses (including breakfast), ferry and ship tickets, road and bridge tolls, parking fees, pollution charges, and similar costs.

3.3. Hansabuss is entitled to increase the price for a confirmed Order by informing the Client at least 10 (ten) calendar days before the start of the service provision if any of the following circumstances arise:

3.3.1. Increases in taxes, duties, service fees, or other costs directly related to the services (including the use of the bus), if this affects the cost of the services;
3.3.2. Increase in transport or fuel costs;
3.3.3. Changes in currency exchange rates.

Cancellation of Order

4.1. The Client has the right to cancel or change the Order by notifying Hansabuss at least 7 (seven) calendar days in advance for transport within the territory of Latvia (hereinafter – Domestic Transport) or at least 14 (fourteen) calendar days in advance for transport outside Latvia (hereinafter – International Transport), counting from the start date of the service provision.

4.2. If the Client provides shorter notice of Order cancellation or changes than specified herein in point 4.1, Hansabuss is entitled to demand contractual penalties in the amounts specified below, which the Client must pay immediately upon receipt of the relevant request:

Domestic Transport:
50% of the Order costs, excluding value-added tax, if the Client provides notice of Order cancellation or changes 6 (six) to 4 (four) calendar days before the planned start date of service provision;
100% of the Order costs, excluding value-added tax, if the Client provides notice of Order cancellation or changes 3 (three) to 1 (one) calendar days before the planned start date of service provision;

International Transport:
50% of the Order costs, excluding value-added tax, if the Client provides notice of Order cancellation or changes 13 (thirteen) to 7 (seven) calendar days before the planned start date of service provision;
100% of the Order costs, excluding value-added tax, if the Client provides notice of Order cancellation or changes 6 (six) to 1 (one) calendar days before the planned start date of service provision;

4.3. If the Client wishes to cancel the Order, the Client must inform Hansabuss of this separately in a reproducible written format (notwithstanding the provisions of point 5.3 herein).
4.4. Changes to the Order are made only according to the carrier’s capabilities.
4.5. If changes to the order are made less than 7 days before the trip, an additional fee of 50 euros will be applied for each change.
4.6. The vehicle capacity in the confirmation is indicative. Exact vehicle details will be sent 24 hours before departure.

Payment

5.1. The fee for services provided by Hansabuss is determined in each individual case by agreement between the Parties.
5.2. In addition to the service fee specified in point 5.1, the Client must pay any additional costs incurred by Hansabuss during the provision of services, according to the invoice submitted after the services have been provided.

5.3. Hansabuss is entitled to demand an advance payment from the Client for the services to be provided according to the advance invoice submitted by Hansabuss. If the Client does not pay the amount specified in the advance invoice by the payment deadline, Hansabuss is entitled to consider that the Client has withdrawn from the Order and not fulfill the Order. If the Client does not provide notice of Order cancellation according to this point 4 and Hansabuss starts providing services despite the lack of advance payment, Hansabuss is entitled to demand a contractual penalty corresponding to the total cost of the Order, excluding value-added tax, and the Client must pay it immediately upon receiving the relevant claim.

5.4. The Client shall pay for the passenger transport services (including additional costs) according to the invoice submitted by Hansabuss. The Client must transfer the amount specified in the invoice to the bank account indicated in the invoice within 7 (seven) calendar days after the Hansabuss invoice is sent. Hansabuss will send the invoice by e-mail or fax to the address or number specified in point 1.2, unless the parties have agreed otherwise.

5.5. With the consent of a customer service specialist, the Client may also pay for the services provided in ways other than transfers, i.e., in cash or by credit card (Visa, MasterCard, or Eurocard) on the bus or after the services have been provided.

5.6. Financial obligations to Hansabuss are considered fulfilled when the amount specified in the invoice is paid in full into the bank account specified by Hansabuss.

5.7. For any overdue amount, Hansabuss is entitled to demand late payment interest in the amount of 0.2% for each calendar day of delay.

Additional Rights and Obligations of Hansabuss

6.1. Hansabuss undertakes to provide passenger transport services as agreed between the Parties (including the Order confirmation), in these Sales Terms, the Transport Regulations, and the applicable laws of the Republic of Latvia, taking into account the usual standards for the provision of passenger transport services.

6.2. If a Passenger to whom Hansabuss provides passenger transport services does not comply with the rules set by Hansabuss, including the Transport Regulations, rules of conduct on the bus, orders or instructions of authorities, or legal acts, and also if the Passenger or their luggage is not ready for transport at the agreed place and time for any reason, Hansabuss is entitled at its discretion to terminate the provision of the passenger transport agreement, cancel the passenger transport agreement, start the trip, and/or demand compensation from the Client for any losses or damages.

6.3. Hansabuss is entitled to use the services of other service providers to fulfill the Client’s order if Hansabuss itself is unable to fulfill the Order using its own resources. In this case, Hansabuss will inform the Client of the service provider’s name and contact information. The Client will pay Hansabuss for the planned transport as if the services were provided using a Hansabuss vehicle.

6.4. Hansabuss undertakes to:
6.4.1. Provide customer service in Latvian;
6.4.2. Provide the Client with bus(es) for use in good technical condition, clean, and provided with driver(s) according to the terms of the passenger transport agreement; Dress the driver(s) in uniform: ironed trousers, formal shirt, dark shoes, and a tie;
6.4.3. Ensure the availability of the bus(es) at the specified place and time confirmed in the Hansabuss Order;
6.4.4. In case of technical failure of the bus(es) during the provision of services, take all reasonable measures that could be expected of it to rectify the failure and continue the trip and, if necessary and possible, replace the damaged bus(es) with equivalent one(s);
6.4.5. Provide fuel for the bus(es).

Additional Rights and Obligations of the Client

7.1. For trips longer than one day, the Client undertakes to provide Hansabuss with a detailed itinerary (times, routes, destinations, and stops) separately for each day no later than 5 (five) calendar days before the start of the passenger transport services. If the itinerary is provided later, Hansabuss cannot guarantee precise adherence to the itinerary.
7.2. Among other things, the Client undertakes to:
7.2.1. Provide Hansabuss driver with accommodation and breakfast at their own expense, if necessary, taking into account the duration of the service provision, and if the Parties have not agreed otherwise before the start of the service provision;
7.2.2. In case of complaints, verbally inform Hansabuss before the passengers disembark. Furthermore, the Client shall prepare the complaint in a reproducible written format, according to point 6.9 of the Transport Regulations;
7.2.3. Provide feedback on the services provided if Hansabuss requests it.
7.2.4. Inform about the cancellation of the order or inconsistency with the proposal in writing.

Hansabuss reserves the right to change the aforementioned Sales Terms without prior notice. The Sales Terms will be considered changed after their publication on the Hansabuss websites.
